1. Information We Collect

We collect information in three ways: information you provide directly, information collected automatically when you use our website, and information from third parties such as advertising platforms.

Information You Provide Directly

When you submit our contact form or intake form, request a quote, or become a customer, we collect:

  • First name, last name, email address, and phone number

  • Property street address, city, state, and postal code

  • Preferred contact method (text, email, or phone)

  • Information about how you heard about us

  • Property details such as square footage, number of rooms, and types of belongings to be documented

  • Special category information voluntarily provided through our intake form, including counts of electronics, jewelry, firearms, fine art, collectibles, wine, and similar items

  • Any additional notes, comments, or messages you choose to share with us

  • Payment information when you book our services (processed by our third-party payment providers, see Section 5)

  • Records of your consent to receive text messages (TCPA-required), including the date, time, IP address, and content of consent

Information We Capture During Service Delivery

When you engage Legacy Vault America for home inventory documentation services, we capture additional information specifically for the purpose of fulfilling your inventory:

  • Photographs of your home, rooms, storage areas, and personal belongings

  • Written descriptions of items including brand, model, condition, and estimated values

  • Serial numbers, model numbers, and identifying details of high-value items

  • Voice memos or audio notes recorded by our team during the documentation visit

  • Receipts, appraisals, certificates, or other supporting documents you provide for high-value items

  • Notes about access details, special instructions, or property-specific considerations

Photographs of your property and belongings are sensitive personal information. We treat this category of data with heightened care, as described in Section 4.

Information Collected Automatically

When you visit legacyvaultamerica.com, we and our third-party service providers automatically collect:

  • IP address and approximate geographic location (city, state, country) derived from your IP

  • Browser type, operating system, device type, and screen size

  • Pages viewed, time spent on each page, click events, and scroll depth

  • Referring website or search query that led you to our site

  • Date and time of your visit

  • Cookie identifiers and similar tracking technologies

  • Heat mapping data (anonymized aggregated visualizations of where visitors click, scroll, and move on the page) where heat mapping is enabled

  • Send membership updates, renewal reminders, and update prompts

  • Respond to your questions and feedback

To Improve Our Website and Services

  • Understand how visitors use our website (which pages, what content, what conversion paths)

  • Diagnose technical issues and improve site performance

  • Test changes to our pages, forms, and content

3. Text Message (SMS) Communications

We send text messages only with your express written consent, captured through the contact form on our website. By checking the consent box on our contact form, you agree to receive text messages from Legacy Vault America at the phone number you provided. These messages may include quote details, appointment confirmations, service updates, membership communications, and promotional offers.

Message frequency varies based on your interactions and stage in the customer journey. Standard message and data rates from your wireless carrier may apply.

To stop receiving text messages, reply STOP to any message we send you. You may also reply HELP for assistance, or contact us at [email protected]. Opting out of text messages will not affect the delivery of services you have already paid for or the documentation you have on file with us.

We retain records of your TCPA consent (date, time, IP address, and consent language) for a minimum of four years, as required by federal regulation.

4. How We Protect Photographs and Inventory Data

Photographs of your home and personal belongings, along with the inventory descriptions, serial numbers, and values we capture, constitute the most sensitive category of data we handle. We apply additional protections to this data:

  • Inventory data is stored in encrypted folders within Google Workspace (Google Drive), accessible only to authorized Legacy Vault America personnel and contractors who have signed confidentiality agreements

  • Customer cloud vaults (for Vault and Concierge members) are individually scoped, meaning each customer can only access their own vault and cannot view the data of other customers

  • We do not transmit your inventory data, photographs, or descriptions to insurance companies on your behalf. If you need to share your inventory with an insurance adjuster, you download the data from your vault and provide it directly. This protects your control over when, how, and to whom your sensitive property information is disclosed.

  • We do not use customer photographs or inventory data for marketing purposes (no "sample inventory" demos using real customer data, no testimonial photos showing real customer items, no advertising images derived from customer captures) unless you provide explicit written authorization for a specific use

  • Access to inventory data is logged and audited periodically

5. Third-Party Service Providers

We use third-party services to operate our website, deliver our services, and communicate with you. These providers receive only the information they need to perform their function. We have agreements in place with our service providers requiring them to handle your data responsibly. The third parties we use include:

Customer Relationship Management and Communications

  • GoHighLevel (HighLevel Inc.) — hosts our website, contact form, intake form, customer database, automated email, and automated SMS infrastructure

Cloud Storage and Email

  • Google Workspace (Google LLC) — hosts customer inventory data, photographs, our business email accounts, and shared internal documents

Payment Processing

  • PayPal Holdings, Inc. — processes online payments where customers choose PayPal at checkout

  • Credit card processor (to be added) — will process credit card payments when this option is launched

  • We do not store your full credit card number on our systems. Payment data is handled directly by the processor.

Analytics and Performance Measurement

  • Google Analytics 4 (Google LLC) — measures website traffic and visitor behavior in aggregate

  • Meta Pixel (Meta Platforms, Inc.) — measures advertising effectiveness and supports retargeting on Facebook and Instagram

  • Heat mapping or session replay tools — we may add tools such as Microsoft Clarity, Hotjar, or similar services to visualize how visitors interact with our pages. These tools record anonymized session data and do not capture sensitive form input.

Maps and Address Services

  • Google Maps (Google LLC) — embedded on our Contact page to display our service area

Independent Contractors

  • From time to time, we may engage independent contractors (such as photographers, documentation assistants, or virtual assistants) to support our work. These contractors are bound by confidentiality agreements and are granted access to customer data only as necessary to complete their assigned tasks.

Legal and Compliance Service Providers

  • Attorneys, accountants, and similar professional advisors who assist Legacy Vault America in operating its business

  • Government agencies, courts, or law enforcement, where required by law or to protect our legal rights

6. We Do Not Sell Your Personal Information

Legacy Vault America does not sell, rent, or trade your personal information to any third party for monetary or other valuable consideration. We have no advertising partnerships in which customer or prospect data is exchanged for compensation.

We may share your information with the third-party service providers described in Section 5 strictly to operate our business and deliver our services. We do not consider this exchange a sale of personal information.

7. Cookies and Tracking Technologies

Our website uses cookies and similar tracking technologies. A cookie is a small text file that is placed on your device when you visit a website. Cookies allow the website to recognize your device, remember your preferences, and measure your interactions.

Categories of Cookies We Use

8. Data Retention

We retain your information only as long as needed to fulfill the purposes described in this Privacy Policy or to comply with our legal obligations. Specific retention periods are:

  • Active customer accounts (active members or active service recipients): retained as long as the relationship is active

  • Customer inventory reports, photographs, and supporting documents (after service ends or membership cancels): retained for twenty-four (24) months after the end of the customer relationship, after which they are securely deleted unless the customer has requested earlier deletion

  • Prospect data (form submissions that did not convert into customers): retained for thirty-six (36) months from the date of submission

  • TCPA consent records (date, time, IP address, consent language for SMS opt-in): retained for at least four (4) years, as required by federal regulation

  • Payment records and transaction history: retained for at least seven (7) years, as required by tax and accounting regulations

  • Aggregated and de-identified analytics data: may be retained indefinitely, as it can no longer be linked to an individual

You may request earlier deletion of your data at any time, subject to our legal obligations to retain certain records. See Section 9 for instructions.

9. Your Rights and Choices

You have the following rights regarding the personal information we hold about you:

  • Access: you may request a copy of the personal information we have about you

  • Correction: you may request that we correct inaccurate or incomplete information

  • Deletion: you may request that we delete your personal information, subject to our legal obligations to retain certain records

  • Opt-out of marketing communications: you may unsubscribe from marketing emails by clicking the unsubscribe link, and stop SMS messages by replying STOP

  • Opt-out of analytics tracking: you may use browser settings or the Google Analytics Opt-out Browser Add-on to disable tracking

  • Withdraw consent: where we rely on your consent to process information, you may withdraw that consent at any time

We may need to verify your identity before fulfilling certain requests, particularly requests for access to or deletion of inventory data.

If we cannot fulfill a request, we will explain why. For example, we cannot delete TCPA consent records or payment records before their legally required retention periods expire.

10. Nevada Residents

Nevada residents have additional rights under Nevada Revised Statutes Chapter 603A, including the right to direct us not to sell certain covered information to third parties. As stated in Section 6, Legacy Vault America does not sell personal information. If our practices change in the future, we will update this Privacy Policy and provide an opt-out mechanism.

11. Children's Privacy

Our website and services are intended for adults aged eighteen (18) and older. We do not knowingly collect personal information from children under thirteen (13) years of age. We do not market to children, and we do not solicit information from children.

In the course of documenting a family home, our work may incidentally include photographs of children's bedrooms or children's belongings (such as toys, electronics, or furniture). We treat these photographs with the same care as all customer inventory data. We do not separately collect, identify, or process information about children, and we do not retain photographs in any form that would identify a specific child.

If you believe we have inadvertently collected personal information from a child under thirteen, please contact us at [email protected] so we can promptly delete it.

12. Data Security

We use administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, alteration, disclosure, or destruction. These safeguards include encryption of inventory data, access controls limiting who can view sensitive data, secure transmission protocols (HTTPS) on our website, and confidentiality agreements with employees and contractors.

No system can guarantee absolute security. While we work hard to protect your information, we cannot promise that data transmitted over the internet or stored on our systems will never be subject to a breach. If we become aware of a breach affecting your data, we will notify you in accordance with applicable law.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, or legal requirements. The "Last Updated" date at the top of this Privacy Policy indicates when it was last revised.
