Welcome to Legacy Vault America. These Terms of Service ("Terms") form a binding agreement between Legacy Vault America LLC, a Nevada limited liability company ("Legacy Vault America," "we," "us," or "our"), and the customer ("you" or "Customer") who books any of our services. By submitting our intake form, paying a deposit, becoming a member, or using our services, you agree to these Terms in full.

If you do not agree to these Terms, do not use our services. If you are agreeing on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

These Terms include important provisions that affect your legal rights, including a binding arbitration clause and a limitation of liability. Please read carefully.

1. Definitions

  • "Customer" means the individual or entity booking, paying for, or receiving services from Legacy Vault America.

  • "Service" means the home inventory documentation services provided by Legacy Vault America, including but not limited to on-site documentation visits, photographic capture, written descriptions, value estimation, report delivery, cloud vault storage, and remote or walk-through updates.

  • "Member" means a Customer who has enrolled in either the Vault Membership or Concierge Membership and whose membership is active and current.

  • "Inventory" or "Inventory Report" means the documented record of your personal property created by Legacy Vault America, including photographs, descriptions, serial numbers, value estimates, and supporting documentation.

  • "High-Value Item" means an individual item with an estimated replacement value above $2,000 to $5,000, depending on category.

  • "Property" means the residence and any associated structures (garage, shed, basement, attic, etc.) at which Legacy Vault America performs the Service.

2. Description of the Service

Legacy Vault America provides professional home inventory documentation services to homeowners in the greater Las Vegas, Nevada area. Our standard Service includes:

  • A scheduled on-site visit to your Property

  • Room-by-room photography of your personal belongings

  • Written descriptions and itemized inventory of significant items

  • Capture of serial numbers, model numbers, and identifying details where applicable

  • Estimated replacement values for standard household items, based on current retail pricing

  • Flagging of High-Value Items with a recommendation for professional appraisal by a credentialed third-party specialist

  • Delivery of a professionally formatted Inventory Report to you within five (5) business days of the on-site visit

  • For Members: secure cloud vault storage of your Inventory Report and supporting files, plus update services as defined in Section 6

Service area: Legacy Vault America currently serves the greater Las Vegas area, including Las Vegas, Henderson, North Las Vegas, Summerlin, Boulder City, and surrounding communities. We may decline to provide Service outside of this area.

3. Service Limitations and Disclaimers

Not an Appraisal Service

Legacy Vault America is NOT an appraisal company. We do not provide appraisals, certified valuations, or formal value opinions. The estimated replacement values we provide for standard household items are based on current retail pricing for comparable items and are intended for general reference only. They do not constitute a formal appraisal and should not be relied upon as such.

For High-Value Items (jewelry, fine art, antiques, collectibles, firearms, musical instruments, fine wine, and similar categories with individual values above $2,000 to $5,000), we strongly recommend a professional appraisal by a credentialed third-party specialist (such as a Gemological Institute of America (GIA) certified gemologist for jewelry, or a USPAP-compliant appraiser for art and antiques). We can provide referrals upon request, but we do not endorse, guarantee, or accept responsibility for the work of any third-party appraiser.

Not Insurance Advice

Legacy Vault America is not a licensed insurance agent, broker, or adjuster. We do not provide insurance advice, recommend specific policies, or interpret the terms of your insurance policy. Information we provide on our website or in connection with our Service about insurance topics (sublimits, scheduled endorsements, ACV vs. RCV, etc.) is for general educational purposes only and is not a substitute for advice from a licensed insurance professional. Consult your insurance agent or broker for advice specific to your policy and coverage needs.

No Guarantee of Insurance Outcomes

While professional documentation generally strengthens an insured's position when filing a claim, Legacy Vault America cannot and does not guarantee any specific outcome with your insurance company. We do not promise that your claim will be approved, paid in full, or paid more quickly than it would have been without documentation. Insurance claim outcomes depend on many factors outside our control, including the terms of your policy, the conduct of your insurance company, the cause and circumstances of the loss, and applicable law.

We Do Not Transmit Your Inventory to Insurance Companies

We do not send your Inventory Report, photographs, or supporting data to insurance companies, adjusters, or any third party on your behalf. If you wish to share your Inventory with an insurance professional, you are solely responsible for downloading, packaging, and transmitting that information yourself. This protects your control over when, how, and to whom your sensitive property information is disclosed.

Items Not Documented

Our standard Service does not include documentation of: food and perishables, toiletries, cleaning products, consumables, items with replacement values clearly under $75, or built-in fixtures (which are typically covered under dwelling insurance, not personal property).

4. Pricing, Deposits, and Payment

Service Pricing

Pricing for the home inventory Service is based on the size of your Property, the density and complexity of items to be documented, and any special categories you have. Starting prices are listed on our Pricing page. Final pricing is determined after you complete our intake form, which generates three priced options: No Membership, Vault Membership, and Concierge Membership. Final price will be confirmed in writing (via email or text) before we begin Service.

Deposits and Balance

To book a Service appointment, Customer must pay a non-refundable deposit equal to fifty percent (50%) of the agreed-upon Service price. The remaining fifty percent (50%) balance is due upon completion of the Service and before delivery of the Inventory Report. We accept payment by all major credit cards, PayPal, cash, and check. We do not begin documentation work until the deposit has been received and confirmed.

Membership Pricing and Billing

Membership pricing is shown on our Pricing page. Memberships are billed in advance:

  • Vault Membership: $19 per month, billed monthly, OR $179 per year, billed annually (saving $49 per year)

  • Concierge Membership: $49 per month, billed monthly, OR $499 per year, billed annually (saving $89 per year)

Memberships auto-renew at the end of each billing period until cancelled by Customer in accordance with Section 6.

Promotional Pricing

From time to time, we may offer promotional or discounted pricing. Any promotional offer is subject to its specific terms and may not be combined with other offers unless we expressly state otherwise.

Taxes and Fees

Prices are exclusive of any applicable sales tax, use tax, or similar government-imposed fees, which will be added to your invoice as required by law.

5. Booking, Cancellation, and Rescheduling

Booking

After you accept your custom quote and pay your deposit, we will schedule your on-site visit at a date and time mutually agreed by you and us, subject to availability. You are responsible for ensuring that the Property is accessible at the scheduled date and time, that all rooms and storage areas you wish to be documented are open and reachable, and that any pets are appropriately secured during the visit.

Cancellation by Customer

You may cancel a scheduled Service appointment at any time. The financial terms of cancellation are:

  • Cancellation more than forty-eight (48) hours before the scheduled appointment: Your deposit is fully refundable, less any processing fees actually charged by our payment processor.

  • Cancellation within forty-eight (48) hours of the scheduled appointment: Your deposit is forfeited and is non-refundable. This policy compensates Legacy Vault America for the loss of the appointment slot, which we cannot reasonably re-fill on short notice.

Rescheduling by Customer

You may reschedule your appointment at no charge if you provide more than forty-eight (48) hours of notice. If you reschedule within forty-eight (48) hours, your deposit is retained and applied to the new appointment date. We will work in good faith to find a new mutually-agreeable date.

Cancellation or Rescheduling by Legacy Vault America

In the rare event that we must cancel or reschedule your appointment (due to illness, weather, equipment failure, or other circumstances), we will notify you as soon as possible and offer a new mutually-agreeable date. If we cannot offer an acceptable alternative date, you may cancel and receive a full refund of your deposit.

No-Show

If our team arrives at the Property at the scheduled date and time and is unable to gain access (e.g., Customer is not present, Property is locked, no one available to admit our team), this constitutes a no-show. Your deposit is forfeited as if you had cancelled within forty-eight hours. To resume Service, a new deposit will be required.

6. Memberships

Membership Benefits

Vault Membership benefits include:

  • 10% discount on the home inventory Service

  • Secure cloud vault storage of your Inventory Report

  • One (1) free remote update per year (additional remote updates billed at the discounted member rate)

  • Discounted walk-through update rate

  • Claim-ready file access (formats commonly accepted by insurance adjusters)

Concierge Membership benefits include:

  • 20% discount on the home inventory Service

  • Secure cloud vault storage of your Inventory Report

  • One (1) free remote update per quarter, up to four (4) free remote updates per year

  • One (1) free in-home walk-through update per year

  • Discounted rate on additional walk-through updates

  • Priority scheduling

Walk-Through Update Limits (Concierge)

The free annual Concierge walk-through update is subject to the following limits:

  • Up to two (2) hours on-site

  • Limited to changes since the last inventory or update; not a full re-inventory

  • Up to twenty-five (25) new or changed items documented during the visit

  • Additional items beyond twenty-five (25) billed at the Member's discounted rate

  • Must be scheduled during normal business hours (Monday through Saturday, 8:00 AM to 6:00 PM)

  • Forty-eight (48) hour cancellation or rescheduling notice required

  • Limited to one (1) Property per Membership; multiple homes each require their own Membership

  • Membership must be active and current at the time of scheduling

Remote Update Limits

Remote updates (whether free as part of a Membership or paid as a one-off Service) are subject to the following limits:

  • Up to fifteen (15) new or changed items per remote update

  • Customer submits photographs and descriptions through the designated process

  • Updated Inventory Report delivered within five (5) business days of submission

  • Additional items beyond fifteen (15) billed at $5 per item

  • Remote updates do not include new appraisal referrals or research on High-Value Items

Auto-Renewal

Memberships are billed automatically and renew at the end of each billing period (monthly or annually, as selected at signup). By enrolling, you authorize Legacy Vault America to charge your payment method on file for each renewal. We will send a renewal reminder before annual renewals; monthly renewals occur without prior reminder. Updated payment information should be provided promptly if your card on file changes or expires.

Member Cancellation

You may cancel your Membership at any time by contacting us at [email protected] or by calling 1-866-L-VAULT-0. Cancellation takes effect at the end of the current billing period. We do not provide refunds for the unused portion of a billing period in which you cancel; you may continue to use Member benefits through the end of that period.

After cancellation, your inventory data is retained for twenty-four (24) months in case you choose to reactivate. After twenty-four (24) months of cancellation, your Inventory and stored data may be permanently deleted unless you have requested earlier deletion or longer retention. Suspension or Termination by Legacy Vault America

We may suspend or terminate your Membership for non-payment, breach of these Terms, conduct that creates a safety issue for our personnel during a visit, or for any other reason permitted by law. We will notify you of any termination and provide an opportunity to cure where reasonable.

7. Customer Responsibilities

By engaging Legacy Vault America for Service, you agree to:

  • Provide accurate and complete information through our intake form. Inaccurate information may result in a quote that does not match the actual Property and may require quote adjustment.

  • Disclose any safety hazards at the Property (aggressive pets, structural issues, hazardous materials, etc.) before our visit.

  • Ensure all areas you wish documented are accessible during the visit.

  • Be present at the Property or arrange for an authorized adult representative to be present during the visit.

  • Not request that we document items you do not legally own or that you do not have the right to permit us to photograph.

  • Pay all amounts due promptly and through the agreed-upon payment method.

  • Maintain accurate payment information on file for any Membership.

  • Notify us promptly of any change in your contact information.

8. Photography, Confidentiality, and Data Use

Photography of Your Property

As part of the Service, our team will photograph the interior of your Property and your personal belongings. By engaging us for Service, you authorize Legacy Vault America to capture, store, and provide to you these photographs in connection with your Inventory Report.

Confidentiality

We treat all customer data, including photographs, descriptions, and supporting documents, as confidential. Our employees and contractors are bound by confidentiality agreements. We will not disclose your data to any third party except: (a) as required by law; (b) to service providers as described in our Privacy Policy; or (c) at your specific written direction.

Marketing Use of Customer Data

We do not use your photographs, your home, your belongings, or any specific details from your Inventory Report for marketing purposes (no sample inventory demos using real customer data, no testimonial photos showing real customer items, no advertising imagery derived from customer captures) unless you provide explicit written authorization for a specific use. We may aggregate de-identified information about our work for general business purposes.

Data Handling

All data captured during the Service is handled in accordance with our Privacy Policy.

9. Intellectual Property

Your Inventory Report

Subject to your full payment of all amounts due, the Inventory Report we deliver to you is yours to keep, use, and share for your personal, non-commercial purposes (including filing insurance claims, supporting estate planning, and similar uses). The photographs we capture of your Property and belongings are also yours to keep and use for these purposes.

Our Methodology and Templates

Our methodology, scoring system, intake form structure, report templates, brand assets, and the formatting and organization of the Inventory Report are the intellectual property of Legacy Vault America. You may not copy, redistribute, license, or commercialize these materials. Nothing in this section prevents you from using your Inventory Report for the purposes described above.

All content on legacyvaultamerica.com, including text, graphics, logos, images, and software, is the property of Legacy Vault America and is protected by copyright, trademark, and other intellectual property laws. You may view and use this content for personal, non-commercial purposes only.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEGACY VAULT AMERICA AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF DATA, OR INSURANCE CLAIM SHORTFALLS, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO LEGACY VAULT AMERICA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND APPLIES EVEN IF A REMEDY OTHERWISE FAILS OF ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any portion of this limitation is unenforceable in your jurisdiction, the remaining portions remain in full effect.

11. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, OR THAT IT WILL BE ERROR-FREE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT YOUR INSURANCE COMPANY WILL ACCEPT, FULLY PAY, OR PROCESS ANY CLAIM YOU FILE BASED ON YOUR INVENTORY REPORT. INSURANCE OUTCOMES DEPEND ON MANY FACTORS OUTSIDE OUR CONTROL.

12. Indemnification

You agree to indemnify, defend, and hold harmless Legacy Vault America and its owners, employees, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of any third party; (c) any inaccurate or misleading information you provide to us; or (d) your use or misuse of your Inventory Report.

13. Dispute Resolution and Binding Arbitration

Informal Resolution First

Before filing a formal claim, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We agree to make a good-faith effort to resolve the dispute within sixty (60) days of receiving your complaint.

Binding Arbitration

If the dispute cannot be resolved informally, you and Legacy Vault America agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Las Vegas, Nevada. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Class Action Waiver

YOU AND LEGACY VAULT AMERICA EACH AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS, AND NEITHER PARTY MAY BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. 

The arbitrator may not consolidate the claims of multiple persons or preside over any form of class or representative proceeding.

Exceptions

This arbitration provision does not apply to: (a) actions to seek injunctive relief to prevent the unauthorized use or disclosure of confidential information or intellectual property; (b) small claims court actions, where available, that do not exceed the jurisdictional limits of the small claims court; or (c) any non-waivable rights under applicable law.

Opt-Out

You may opt out of this arbitration provision by notifying us in writing within thirty (30) days of first agreeing to these Terms. Send your opt-out notice to [email protected] with the subject line "Arbitration Opt-Out" and include your name, the date you accepted these Terms, and a clear statement that you wish to opt out. Opting out of arbitration does not affect any other provision of these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict-of-laws principles. Subject to the binding arbitration provision in Section 13, any judicial proceeding (including small claims actions or actions for injunctive relief) shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.

15. Modifications to These Terms

We may update these Terms from time to time to reflect changes in our Service, our pricing, applicable law, or our business practices. The "Last Updated" date at the top indicates when the Terms were last revised. Material changes will be communicated to you by email or by prominent notice on our website. Your continued use of the Service after the effective date of the updated Terms means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel any active Membership in accordance with Section 6.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and SMS Terms, constitute the entire agreement between you and Legacy Vault America regarding the Service and supersede any prior or contemporaneous agreements, representations, or understandings.

Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or of our right to enforce it later.

Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.

Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, or pandemic.

We may provide notices to you by email at the address you provided to us, by text message at the phone number you provided, or by posting notice on our website. You should provide notices to us at [email protected] or at the mailing address in Section 17.
